OBJECT

This Legal Notice regulates the access, navigation and use of the Web, without prejudice that PROCELI reserves the right to modify the presentation, configuration and content of the same, as well as the conditions required for its access and/or use. The access and use of the contents of the Web after the entry into force of its modifications or changes supposes the acceptance of the same ones.

PROCELI reserves the right to modify the terms and conditions herein stipulated, in whole or in part, by posting any changes in the same way that this Legal Notice appears or through any type of communication addressed to users.

In the same way, we inform to the users about what their rights and their obligations in relation to the contents exposed through the WEB, logos and trademarks used, as well as the responsibilities that can derive from the access to it.

For the purposes of the interpretation of these Terms of Use, we understand that a person becomes a user at the time that it accepts the Conditions of Use exposed on the Web, enough for it to visit.

Failure to comply with any of the foregoing obligations by the user may entail the adoption by PROCELI of the appropriate measures covered by lay and in the exercise of his rights or obligations, without any possibility of compensation whatsoever for the damages caused.

References to registered trademarks or trade names, or other distinctive signs, whether owned by PROCELI or third party companies, are implicit in the prohibition on their use without the consent of PROCELI or its rightful holders. At no time, unless otherwise expressly stated, the access, navigation or use of the Website and/or its contents confers upon the user any right on distinctive signs included therein.

All rights of intellectual and industrial property are reserved for the contents of the Web and, in particular, it is forbidden to modify, copy, reproduce, communicate publicly, transform or distribute, by any means and in any form, all or part of the content included on the Web, for public or commercial purposes, if you do not have the prior authorization, express and in writing of PROCELI or, where appropriate, the holder of the corresponding rights.

The user acknowledges the responsibility, leaving the provider unscathed for any communication that he or she provides personally or in his/her name, achieving such liability without restriction whatsoever of the accuracy, legality, originality and ownership of the same.

 

LINKS TO OTHER WEBSITES, PLATFORMS AND SOCIAL NETWORKS

PROCELI does not control the contents, privacy policies or practices of third party websites or assume any responsibility for them.

The user acknowledges and accepts that PROCELI will not be responsible for the availability of the websites or external resources, and does not subscribe any advertising, products or other materials offered through such websites or resources.

PROCELI makes available to users, through different tools and applications, means of linking that allow users to access the channels and pages of the Web that PROCELI maintains in different platforms and social networks belonging and/or managed by third parties (e.g. Facebook, Twitter, etc.). The inclusion of these links on the WEB has the sole purpose of providing users with access to such channels on different platforms and social networks.

The establishment of these applications does not imply the existence of any relationship between PROCELI and the owner, manufacturer or distributor of the linked platform, nor the acceptance and approval by PROCELI of its contents and/or services, being its owner, manufacturer or distributor the only person responsible for them.

In no case PROCELI shares with Facebook, Twitter or any other social network that will incorporate in the future any kind of private information about its users, being the only purpose established in this Legal Notice, as well as in the Privacy Policy of the Web. In this sense, all the information that the user wants to provide to these platforms will be at his own risk, not intervening PROCELI in that process.

The activation and use of these applications can lead to the identification and authentication of the user (login/password) on the corresponding platforms, completely external to the WEB, so PROCELI will not assume any responsibility on the security settings for those environments.

 

RESPONSIBILITIES AND GUARANTEES

Consequently, PROCELI does not guarantee nor is responsible for the continuity of the contents of the Web, of the absence of errors in these contents, as well as of the absence of viruses and/or other harmful components, of the invulnerability of the Web and/or the impossibility of to infringe the security measures taken in the same, of the lack of utility or performance of the contents of the Web, as well as of the damages that cause, to himself or to a third, any person who infringed the conditions , rules and instructions that PROCELI establishes on the Web or through the infringement of the security systems of the same.

PROCELI declares that it has taken all the necessary measures, within its possibilities and the state of the art, to guarantee the operation of the WEB and to minimize the errors of the system, both from the technical point of view and legal and organisational.

PROCELI not be responsible for the veracity, integrity or updating of the information published on the Web from sources outside the same.

 

WEB SITE SUSPENSION

PROCELI reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, access, browsing, use, hosting and/or downloading the content and/or use of WEB services, with or without prior notice, without the User’s ability to demand compensation for this cause.

 

CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of the current legislation on Data Protection, all personal data provided during the use of the WEB will be treated in accordance with the provisions of the Privacy Policy.

 

APPLICABLE LEGISLATION AND COMPETENT JURISDICTION

Provided that the current regulations for the purpose provide for the possibility for the parties to submit to a particular jurisdiction, for any litigation arising or related to this Website will apply the Spanish legislation in force at the time of litigation, and we will submit to the courts and Tribunals of Terrassa, as well as, where appropriate, to the Arbitral Courts of consumption or similar to those that we find adhered at the time of the controversy.
